When the Calendar Speaks Louder Than the Evidence

There is a rhythm to the way justice is supposed to move—deliberate, unhurried, indifferent to the calendar. When a federal judge on Monday dismissed the case against two former FBI officials, he did so not because the allegations were necessarily untrue, but because the timing and the manner of their pursuit suggested something other than the ordinary work of the law.

U.S. Magistrate Judge Zia Faruqui threw out the charges against Nikki Floris and Bradley Benavides, former officials of the FBI's Foreign Influence Task Force, who had been accused of lying to Congress in 2023 about their knowledge of the investigation into Hunter Biden's laptop . The judge's language was unusually direct. "What has transpired here cannot be described as anything other than weaponization," he said from the bench .

The procedural details matter. The Justice Department brought the charges on October 23 via a criminal complaint rather than the customary grand jury indictment—an approach typically reserved for defendants who pose a flight risk or immediate danger . Faruqui noted that the investigation had been opened on July 17, a day after President Trump delivered a national address centered on his 2020 election loss, and that it was mandated and closely monitored by FBI Director Kash Patel . The case could have been brought at any point after the officials' 2023 testimony, but it arrived less than two weeks before the midterm elections. "I will not bury my head in the sand and pretend that I cannot read a calendar," the judge said .

An FBI agent who worked the case testified that he had concerns it would be viewed as political, and that within the agency, "people generally viewed" the investigation as a "witch-hunt" . He acknowledged finding no evidence of a motive for the alleged lies, and no evidence that the congressional investigation had been slowed or altered by the officials' testimony . The judge said that without motive, there was nothing to support a finding of probable cause.

The Justice Department may still seek a grand jury indictment, and the dismissal does not foreclose that path. But the ruling represents a setback for a prosecution that had already drawn scrutiny for its unorthodox handling. The case against Floris and Benavides was part of a broader effort to revisit the FBI's conduct during the 2020 campaign, a grievance that has animated the president and his allies for years.

For the two former officials, the dismissal brings a measure of relief but not vindication. The investigation may continue, or it may not. What the judge made clear is that the machinery of justice, when it moves at the pace of politics, risks losing the very authority it seeks to exercise.
