The cases had been dismissed by a lower court, which ruled the plaintiffs’ scientific evidence did not meet required legal standards. During the appeal, judges questioned parts of the lower court’s approach, suggesting some expert testimony may have been improperly excluded and that a jury could potentially weigh the evidence. The litigation now continues under appellate review.
