Preserving the Franchise Promise: Congress Moves to Clarify Joint Employer Rules

In the quietly turbulent world of labor law, Congress has introduced a piece of legislation with outsized implications for millions of small business owners and their workers. The American Franchise Act—recently filed in the House of Representatives—seeks to codify a clearer definition of when a franchisor may be considered a “joint employer” of its franchisee’s employees. It’s a small change in language, but one that could reshape how responsibility and risk are shared in the vast franchise economy.

At its core, the bill draws a line: a franchisor should only face joint-employer liability if it has “substantial direct and immediate control” over essential terms of employment. This means decisions that genuinely affect wages, hiring, scheduling, or supervision—not just routine brand standards, training protocols, or operations guidance. According to the bill’s sponsors, that distinction protects the independence of franchisees while preserving accountability for serious, hands-on oversight.

For decades, the franchise business model has acted as a powerful engine of economic opportunity. According to government-sponsored research cited in the bill, franchises contribute hundreds of billions in economic output and employ millions of workers. But that model has been challenged by shifting interpretations of the joint-employer standard, especially in recent years when regulatory bodies tried to apply more expansive definitions—holding franchisors liable even when their control was remote or indirect. The uncertainty has unsettled business owners, advocates say, weighing on investment and growth.

Supporters of the American Franchise Act argue it offers stability. The International Franchise Association, a leading voice for franchise businesses, praised the bill as a landmark moment, saying it would finally resolve the regulatory roller coaster that has plagued the industry. A clear, predictable rule could free many franchisees to operate with confidence and without constant legal overhang.

Advocacy groups and taxpayer organizations have also backed the legislation, arguing that this clarity is not merely a boon to business, but a protection for workers and local economies. By reestablishing a “direct-control” standard, they say, the law would help ensure that liability is tied to real authority and not vague or theoretical influence.
