On a Golf Course, the Law Does Not Take a Holiday

There is a quiet assumption we carry about certain places—that the rules soften at the edges of recreation, that a golf course exists in a gentler world where the ordinary weight of law might not follow. Yet the law, like gravity, does not pause for leisure. On a Saturday afternoon in Timberlea, Nova Scotia, that truth arrived in the form of a rolled cart and a breathalyzer reading, a reminder that responsibility travels with us wherever we go.

RCMP Halifax Regional Detachment has charged a 33-year-old Halifax man with impaired driving following a golf cart rollover at The Links at Brunello golf course in Timberlea. On October 10, at approximately 1:30 p.m., RCMP, Emergency Health Services, and fire services responded to a single-vehicle crash at the course on Brunello Boulevard. Officers learned that a golf cart carrying two occupants had rolled over.

The passenger suffered non-life-threatening injuries and received first aid at the scene. When officers spoke with the driver, they observed signs of impairment. A roadside breath sample resulted in a fail, and the man was arrested for impaired driving. He was transported to the Tantallon RCMP Detachment, where he provided two breath samples registering 130 mg% each.

The charge may surprise some, given the setting and the vehicle. But RCMP Cpl. Mandy Edwards explained that the law casts a wider net than many realize. "Most people think that it's just on the roadway or public property," she said. "But the Criminal Code section that deals with impaired driving does not differentiate between private or public. So that means someone who is operating a ride-on lawnmower at their home can also face impaired driving charges if they are found to be impaired".

Edwards noted that a motor vehicle is broadly defined as any vehicle propelled or driven by means other than muscular power. In addition to cars, trucks, and motorcycles, operators of ATVs, snowmobiles, motorized scooters, golf carts, and ride-on lawnmowers can all be charged with impaired driving. The law, in its quiet way, follows function rather than form—asking not what the vehicle looks like, but what it can do when judgment is clouded.

The man was released and is scheduled to appear in Halifax Provincial Court at a later date. For the passenger, the afternoon ended with minor injuries; for the driver, with a criminal charge that will follow him beyond the fairways and into the ordinary spaces of his life.

What remains, beneath the headlines, is a simple truth: wherever a motor hums and wheels turn, the obligation to be present and clear-minded does not take a holiday. The golf course, with its green lawns and gentle pace, is no exception.
