“Law and Order at a Crossroads: Serving Garda Set for Criminal Trial”

In a rare and serious development for Ireland’s national police force, a serving member of An Garda Síochána is set to face trial on a string of criminal charges, including burglary, harassment, criminal damage, assault and sending grossly offensive messages — allegations that, if proven, will mark one of the more notable instances of a serving officer being brought before a jury on such matters in recent years.

The case concerns Garda Alan O’Mahony, stationed at Letterkenny Garda Station in County Donegal, who was mentioned before Judge Ciarán Liddy at Letterkenny District Court this week and will now proceed to Letterkenny Circuit Court for trial.

Mr. O’Mahony, who has an address in Cork and was not present in court because he is currently off on sick leave, faces five charges arising from alleged incidents on June 30, 2024, at Wood Park, Lismonaghan, Letterkenny:

Burglary — entering a property as a trespasser with intent to commit an arrestable offence under the Criminal Justice (Theft and Fraud) Offences Act, 2001. Criminal damage — allegedly setting fire to a duvet with a lit cigarette and damaging the handle of a front door, both in the same location and on the same date. Assault — harming a man named Joseph O’Donnell at the same address. Harassment / offensive communication — sending a grossly offensive message (a photograph of a named woman) to another person with the intent to cause harm, contrary to the Harassment, Harmful Communications and Related Offences Act, 2020. The Director of Public Prosecutions (DPP) has consented to the prosecution moving forward on all counts. Defence legal representation was discussed in court, and the case has been adjourned to March 3, 2026 to facilitate consideration of legal pleas and counsel arrangements.

The progression of these charges against a serving Garda underscores the principle that members of An Garda Síochána are subject to the same laws and judicial processes as other citizens when accused of wrongdoing. While details about the alleged offences are limited to dates, locations and statutory categories, the move to Circuit Court indicates the seriousness with which the State intends to pursue the matter prior to a full trial.

As the legal process unfolds, this case will be monitored closely by both legal observers and the public, given the responsibilities held by Gardaí and the ethical standards to which they are held. The Garda involved remains in active service but on sick leave, and no convictions have been recorded; all charges are as yet allegations that will be tested in court as the justice system runs its course.
