THE HAGUE, Netherlands — The International Criminal Court (ICC) formally opened the confirmation of charges hearing on Monday, February 23, 2026 against former Philippine President Rodrigo Duterte, with prosecutors laying out the foundation of their case alleging crimes against humanity tied to his war on drugs policies.
Deputy Prosecutor Mame Mandiaye Niang told the Pre Trial Chamber I that the proceedings underscore the principle that “those in power are not above the law,” and urged judges to consider the victims’ suffering as evidence is evaluated. The hearing — scheduled to run through Feb. 27 — will determine whether enough evidence exists to send the case to a full trial, with judges having up to 60 days after the hearing ends to issue a decision.
Duterte did not attend the first day in person; having waived his right to appear despite previously being found fit to take part in the proceedings. His legal team, led by lawyer Nicholas Kaufman, represented him at the hearing and delivered an opening statement challenging the evidence and asserting political motives behind the prosecution.
On Day 1, ICC prosecutors began presenting evidence and witness accounts, including materials they say show Duterte founded and directed the notorious Davao Death Squad — a network allegedly responsible for extrajudicial killings during his time as mayor of Davao City. Prosecutors introduced a slide displaying individuals described as co perpetrators in the alleged crimes.
Families of extrajudicial killing victims were present in The Hague and in the Philippines, with some describing the hearing as “traumatic” as memories of losses resurfaced while evidence was presented. The first day included opening arguments from the prosecution, defense and victims’ legal representatives. Victims’ counsel emphasized the personal impact of the alleged killings and urged the court to confirm charges and hold Duterte accountable.
The confirmation hearing marks a pivotal phase in the ICC’s scrutiny of Duterte’s anti drug campaign and its alleged human cost, drawing intense attention from international observers, human rights advocates, and supporters on both sides of the issue.
