Historic Verdict in Damascus: Ousted President Bashar al-Assad and Atef Najib Sentenced to Death

DAMASCUS, SYRIA — In a landmark moment for transitional justice, a Syrian court in Damascus on Tuesday, August 11, 2026 sentenced ousted President Bashar al-Assad and his former Political Security chief Atef Najib to death for crimes against humanity and war crimes committed during Syria’s 14-year conflict.

The ruling marks the conclusion of Case No. 1 of 2026, the first major prosecution targeting top officials of the former regime. Assad was sentenced in absentia along with his brother, Maher al-Assad, following their flight to Russia.

Unlike the absent former president, Atef Najib—Assad’s maternal cousin and former head of Political Security in Daraa—stood inside a metal defendant's cage in a prisoner’s uniform as the sentence was delivered.

Following the collapse of the regime, Najib was arrested in early 2025 and subsequently became the highest-ranking former official to face trial in person. Within Syria's evolving transitional justice framework, his in-custody prosecution stood alongside major in-absentia judgments passed down against top regime leaders who fled the country, including former President Bashar al-Assad and his brother Maher al-Assad.

The charges centered heavily on the brutal suppression of peaceful protests in Daraa in 2011. Forces under Najib's command arrested and tortured school children for writing anti-regime graffiti, an act widely regarded as the spark that ignited the Syrian revolution.

The prosecution presented extensive witness testimonies and documentary evidence outlining systematic torture, forced disappearances, and orders to fire directly upon civilian demonstrators.

The verdict was met with emotional reactions outside the Palace of Justice, where families of victims gathered. For millions of Syrians affected by over a decade of war, the historic sentence serves as a crucial step toward accountability, even as key figures remain outside the reach of local authorities.

Despite the verdict’s historic nature, human rights organizations and legal experts have noted the significant challenges that lie ahead regarding enforcement and international law. With Bashar al-Assad and Maher al-Assad granted asylum in Russia following the collapse of their regime, executing the in-absentia death sentences remains virtually impossible without international extradition support.

Meanwhile, international observers have urged the transitional judiciary to maintain rigorous legal standards and avoid swift executions for detained figures like Najib, warning that premature capital punishment could jeopardize the documentation of vital evidence and chain-of-command records needed for comprehensive institutional healing.
