A Dorm Room, a False Promise, and a Death That Could Have Been Prevented

There are stories that arrive not as news but as warnings, stories that unfold in dorm rooms and text messages and the quiet minutes when help could have been called but was not. The case against Moises Freire is one of those stories, and the details, as federal prosecutors have laid them out, are almost impossible to absorb without a pause.

Freire, 19, of the Bronx, is accused of bringing fentanyl to the dorm room of two Fashion Institute of Technology students on March 18, telling them it was pure cocaine from Mexico. Prosecutors say he knew it was deadly—he had described the substance in a text message as “straight poison” and “fake” before offering it to them . Both women lost consciousness almost immediately after ingesting it.

What happened next is at the center of the charges unsealed this week. According to the U.S. Attorney’s Office for the Southern District of New York, Freire raped one of the women, Annabel Richter, while she lay unconscious. He did not call for help for approximately 45 minutes. During that time, prosecutors say, he sent photos of the unconscious women to others, including one image showing Richter nude below the waist . When he finally approached campus security, he falsely claimed the women had simply consumed too much alcohol .

Campus security administered Narcan. Both women were transported to hospitals. Richter never regained consciousness. She died three days later from complications of acute fentanyl intoxication . Her roommate survived. A third defendant, Harry Rosales Pino, has pleaded guilty to narcotics distribution resulting in death .

Freire faces charges including conspiracy to distribute a controlled substance resulting in death and serious bodily injury, which carries a mandatory minimum of 20 years and a maximum of life in prison. He is also charged with distributing fentanyl with the intent to commit rape, which carries a maximum of 20 years . He has pleaded not guilty to the initial charges, and his attorney said during an April hearing that Freire and Richter had a “sexual relationship” for more than a year and that she had repeatedly asked him to acquire drugs for her .

Richter’s mother, Flavia Rocha, described her daughter as a “luminous presence” who “had so many plans and aspirations for the future.” “We hope her story brings awareness about the deadly harms our kids are exposed to,” she said, “and their vulnerabilities, especially when it comes to the safety of young women” .

FIT President Jason Schupbach said in an email to students that the university has reviewed and enhanced safety protocols following Richter’s death . The case remains pending, with a trial tentatively scheduled for March 2027.
