On January 7, 2026, the Delhi High Court, presided over by Justice Mini Pushkarna, passed an interim order directing the Indian National Congress and the Aam Aadmi Party to remove within 24 hours social media posts linking Bharatiya Janata Party national general secretary Dushyant Kumar Gautam to the 2022 Ankita Bhandari murder case. The order followed a defamation lawsuit filed by Gautam, who argued that the posts had falsely implicated him as a “VIP” figure in the long-closed murder investigation.

The court’s instructions extended not only to the two political parties but also to other individuals and entities — including actor Urmila Sanawar and the Uttarakhand Pradesh Congress Committee — to take down allegedly defamatory content. Justice Pushkarna emphasized that Gautam had established a prima facie case in his favour and noted that, without immediate relief, he could suffer irreparable injury to his reputation.

Crucially, the judge restrained the defendants from further uploading, publishing, or circulating content that names, targets, or imputes that Gautam was involved in the murder of Bhandari. The order also stipulated that if the defendants did not comply within the specified time, intermediary platforms such as X, Meta and Google would be required under existing rules to remove the content themselves.

The 2022 murder of 19-year-old Ankita Bhandari, a receptionist at a resort in Uttarakhand, drew widespread attention and led to life sentences for the resort owner and two employees. However, the official investigation did not see Gautam’s name figure as a suspect, and his petition underscored that unverified online claims had begun circulating without judicial basis.

Amid ongoing political rivalries, the court’s order highlights the tension between freedom of expression and protection of personal reputation — a balance that India’s judiciary continues to navigate in an era where social media posts can travel far faster than facts.
