When the Tax Is Removed, the Regulation Cannot Stand

The Justice Department will no longer enforce NFA registration requirements for suppressors, short-barreled rifles, and similar firearms after a court ruled the regulations can’t stand without the tax that supported them.

When the Tax Is Removed, the Regulation Cannot Stand

There is a particular relationship between taxation and regulation—a bond so tightly woven into the fabric of American law that when one is removed, the other often cannot stand. That principle, affirmed by a Texas federal court in August, has now reshaped federal firearms policy in ways that will affect gun owners across the country.

The Justice Department announced Friday that it will no longer enforce registration requirements for suppressors, short-barreled rifles, short-barreled shotguns, and certain other firearms under the National Firearms Act . The decision follows a ruling by U.S. District Judge James Hendrix, who found that the NFA’s regulatory provisions could not be sustained after Congress eliminated the $200 tax on those items in the One Big Beautiful Bill Act .

“The direction from the President, Congress, and the courts is clear,” said Rob Cekada, director of the Bureau of Alcohol, Tobacco, Firearms and Explosives. “ATF is now following suit with our enforcement posture while continuing to ensure we remain focused where we are needed the most: combating violent crime in American communities” .

Under the new guidance, individuals will no longer need to apply for and receive ATF approval before making or transferring short-barreled rifles, short-barreled shotguns, suppressors, or “any other weapons” as defined by law . The registration and tax-stamp requirements for those items will not be enforced. However, the $200 tax remains in place for machine guns and destructive devices, and those weapons remain fully regulated .

The ruling’s logic was straightforward. Judge Hendrix wrote that “because today’s NFA does not generate any revenue from untaxed firearms, its regulatory provisions cannot be upheld under the taxing power” . The court’s decision was limited to the parties in the lawsuit, but the Justice Department chose to apply the guidance nationwide to avoid what Cekada described as a confusing patchwork of regulations .

The policy change does not supersede state and local laws. About fifteen states have their own registration requirements, and ATF will continue processing applications submitted under those laws . Licensed dealers must still complete standard firearms forms, run background checks, and maintain records. The Gun Control Act’s requirement to obtain approval before transporting short-barreled rifles and shotguns in interstate commerce also remains in effect .

The National Firearms Act was enacted in 1934 in response to concerns about mob violence during Prohibition, imposing taxes and registration requirements on particularly concealable and dangerous weapons . For nearly a century, its regulatory machinery rested on the taxing power. Now, with that tax removed for a category of firearms, the machinery has been found to lack a foundation.

The Justice Department’s decision not to appeal, first reported by CBS News, was a departure from the recommendations of many lawyers within the department who argued the ruling was adversely impacting ongoing criminal cases . But the administration chose a different path, one that gun rights advocates have long urged and that courts have now set in motion.
