When the President’s Own Words Become the Government’s Worst Evidence

When the President’s Own Words Become the Government’s Worst Evidence

There is a peculiar irony that settles over a courtroom when the government’s own words become the most persuasive evidence against it. In a Washington federal courtroom this week, the Justice Department attempted to defend President Trump’s ban on three news outlets from the White House complex—CNN, MS NOW, and Politico—only to find that the president’s public statements had already undermined the case.

The ban, announced on social media on September 18, described the outlets as “fake news” and declared they should not be permitted to report from the White House . The three organizations sued within days, arguing the action violated their First Amendment and due process rights. U.S. District Judge Timothy Kelly, a Trump appointee, temporarily blocked the ban on September 24, finding it likely violated the Fifth Amendment’s guarantee of fair treatment .

At Thursday’s hearing, the outlets’ attorney, Theodore Boutrous, argued that Trump’s own words revealed the true motive. He pointed to a recent Time magazine interview in which the president indicated other outlets might be “next” . “He wants to coerce better coverage,” Boutrous told the judge, describing a “potent chilling effect” on reporters who might fear losing access if their work displeased the president .

Justice Department attorney Michael Velchik countered that the outlets had published classified information and “verifiable falsehoods,” and that access to restricted presidential spaces is a privilege, not a right . But when pressed by Judge Kelly, the government’s arguments seemed to strain against the plain record. Kelly noted the “unusual” fact pattern in which “the decision maker seems to have said … I am taking this action because ‘x’ and ‘y’,” while the government now claimed a different justification .

The judge also questioned whether national security concerns genuinely justified the ban. He described the government’s cited cases as involving “hair-on-fire” emergencies, while this situation appeared more “attenuated” . The White House had sent letters to the outlets citing specific stories, but those letters arrived only after the lawsuit was filed, raising questions about whether they were after-the-fact rationalizations .

The hearing unfolded against a broader backdrop of press access tensions. Since the temporary restraining order restored the outlets’ credentials, the White House has blocked CNN and Politico from traveling on Air Force One on multiple occasions . Other networks temporarily withheld pool coverage in solidarity. The White House Correspondents’ Association president met with Trump aboard Air Force One to advocate for press access .

Judge Kelly extended his temporary block for two additional business days and said he would rule by Tuesday on whether to impose a longer-term injunction . Whatever his decision, the hearing made one thing clear: the president’s own public statements have become the Justice Department’s most difficult obstacle.
