When a Monument Meets the Machinery of Environmental Law

There is a particular tension that arises when a monument designed to honor the past collides with the practical concerns of the present—when the symbol of national memory meets the traffic patterns, emergency routes, and environmental reviews that govern how a community actually functions. In Arlington County, Virginia, that tension has now moved from public comment to federal court.

The Arlington County Board filed a lawsuit Thursday against the Trump administration and the National Park Service, seeking to halt construction of a planned 250-foot Triumphal Arch at Memorial Circle, just across the Potomac River from Washington . The lawsuit, filed in the Eastern District of Virginia, is the first legal action by a governmental body against the project .

The county's complaint argues that the National Park Service failed to take the "hard look" at environmental impacts required by the National Environmental Policy Act before rushing toward construction. "Although the agency has claimed that a final decision to construct the Arch has not yet been made and purports to be engaged in a routine decisional process, that rushed process appears to be a pretext designed to shore up justifications for building the Arch in accordance with the President's repeated marching orders," the lawsuit states .

The arch, which Trump first unveiled in October 2025 as a monument to the 250th anniversary of American independence, would stand 250 feet tall—more than twice the height of the Lincoln Memorial and roughly equivalent to a 25-story building . More recently, Trump described it as a "top-grade Military Complex/Triumphal Arch" capable of storing ammunition and housing drones and snipers .

Arlington County Board Chair Matt de Ferranti said the county "has the most to lose from this egregious and unlawful proposed project." He added that the county engaged in the review process in good faith, pointing out "severe, unique, and wide-ranging negative impacts" to residents, "only to see them ignored" .

The complaint cites specific harms: the arch would obstruct the deliberate sightline between the Lincoln Memorial and Arlington National Cemetery, symbolizing post-Civil War reunification. It would clog thoroughfares needed for emergency transport services and threaten to increase noise and air pollution by diverting flights into and out of Reagan National Airport .

The lawsuit adds to a growing list of challenges. A group of veterans and an architectural historian have already sued, arguing the project needs congressional approval. A judge in that case ordered the administration to give the court 48 hours' notice before any construction-related activities . The Association of Flight Attendants-CWA has also raised safety concerns, noting the arch's height compounds issues unaddressed since a deadly January 2025 midair collision over the Potomac .

White House spokesman Davis Ingle said the administration has been "fastidiously compliant with all procedural and legal requirements and are certain this meritless and dilatory lawsuit will be dismissed." He added that the arch "will become one of the world's most iconic landmarks" .

Memorial Circle sits on federal parkland immediately adjacent to Arlington County. The county is represented by Democracy Forward, which argued that "the president is not allowed to bypass legal review requirements just because he wants to move quickly on his own whims" .

The case is County Board of Arlington County, VA v. National Park Service, et al. A hearing has not yet been scheduled.
