Tompkins County District Attorney Matthew Van Houten has said he did not see the transcript when his office decided not to bring charges. He said the office relied on a written statement prepared by a campus police officer and signed by the woman.

Van Houten previously said the evidence available to his office did not establish sufficient grounds for prosecution under the applicable criminal law. After the allegations resurfaced through the civil lawsuit and additional material came to light, he announced that the investigation would be reopened.

Cornell University has also taken steps related to the allegations. The university suspended the Chi Phi fraternity after being notified of the report in November 2024, and disciplinary proceedings involving students followed. Cornell has now agreed to an independent investigation as renewed attention focuses on how the allegations were handled.

The renewed investigation does not establish that any individual committed a crime. The allegations remain allegations, and several of the men named in the civil case have denied them. The criminal investigation and the civil lawsuit are separate proceedings, with different standards and purposes, and neither should be treated as a final determination of the facts.
