What does it mean when the FBI's past is prosecuted in the present?

The laptop was a strange object from the beginning—a computer dropped off at a repair shop in Wilmington, Delaware, its contents eventually reaching the New York Post through Rudy Giuliani, its existence surfacing in the final weeks of the 2020 presidential campaign. It contained emails that appeared to show discussions of Hunter Biden's foreign business dealings. It raised questions about Russian disinformation, about the FBI's handling of the matter, and about what officials knew and when they knew it. On Friday, two former FBI intelligence officials who specialized in foreign election interference were charged with lying to Congress about their roles in that investigation .

Nikki Floris and Bradley Benavides surrendered Friday and appeared in federal court in Washington. The Justice Department alleges they lied to Congress in 2023 about the involvement of a specialized foreign-influence task force in investigations into Hunter Biden, as well as their knowledge of the laptop . Floris led the Foreign Intelligence Task Force as deputy assistant director from mid-2019 to mid-2022; Benavides served as its section chief through the 2020 election . Both told the House Judiciary Committee that the task force was not involved in the Hunter Biden investigations, according to prosecutors. Benavides testified that he learned the FBI had Hunter Biden's laptop only from a Wikipedia article in 2023, but prosecutors said he had regularly discussed the laptop with FBI officials before the 2020 election .

The case was filed ten days before the November 3 elections and marks the latest in a series of politically charged investigative actions the Department of Justice has undertaken in the run-up to the midterms . Floris's attorneys called her "a patriot" and said she has "served our nation as a dedicated FBI intelligence officer for nearly 20 years." They said the charges were brought "on the say-so of politicians, not on the facts" and noted the timing. "It's no coincidence the government is filing these nonsense charges now, years later, on the eve of an election" .

FBI Director Kash Patel, who before taking over the bureau was a harsh critic of it, said in a statement posted on X: "Lying to Congress by senior FBI officials strikes at the heart of our system. No one is above the law" . US Attorney Jeanine Pirro said, "When senior FBI agents lie to Congress believing they are above the law, it's time to bring the hammer of justice down on them" . Patel also said one of the defendants was "on record privately claiming to be 'running a shadow government' during the 2020 election" .

The task force itself was established during the first Trump administration to police influence campaigns staged by Russia and other nations. It became a magnet of congressional Republican criticism during the Biden investigation and was disbanded in February 2025 by then-Attorney General Pam Bondi . The prosecution revisits a tangled saga that roiled the final weeks of the 2020 race, when the laptop's contents were publicized and concerns about Russian disinformation were raised by Democrats and former intelligence officials.

Hunter Biden was subsequently charged with and convicted of gun and tax offenses during his father's administration. Joe Biden pardoned him in his final weeks in office . The laptop, the task force, and the question of who knew what about the computer have now become the subject of a criminal case that will unfold in the weeks before an election, adding another layer to a story that has never quite ended.

Floris and Benavides have not yet entered pleas. Their lawyers pressed for a speedy hearing at which they could contest the allegations. The case will proceed in federal court in Washington, a city where the lines between investigation and politics have rarely seemed so thin.
