The Agent Is on Leave, but the Questions Remain

On a Saturday morning in northwest Harris County, the ordinary rhythms of a Houston suburb were interrupted by something that has become increasingly familiar in America's immigration enforcement landscape: a chase, a collision, and a man left lying on the pavement. What happened next—the decision to place the ICE agent involved on administrative leave—is a procedural step, yet it carries the weight of a community's demand for answers.

The agent who allegedly ran over 48-year-old Miguel Parra Hernández during an immigration enforcement operation has been placed on administrative leave while an internal investigation proceeds, a senior Department of Homeland Security official told NBC News . The incident occurred Saturday morning near Clay Road and Highway 6, when ICE agents attempted to stop a white truck. According to the Harris County Sheriff's Office, the truck drove the wrong way down Clay Road before stopping, and two men fled on foot .

Parra Hernández was struck by an ICE vehicle and rushed to a local hospital, where he underwent surgery for a broken leg and also needs surgery on his ankle, according to his attorney, Kim Bruno . He remains in ICE custody at the hospital .

The case has drawn intense scrutiny because of what Harris County District Attorney Sean Teare has described as evidence suggesting the collision was intentional. "From my perspective and from the perspective of a lot of different investigators who have looked at this, that individual was intentionally struck and run over," Teare said . His office is considering potential aggravated assault with a deadly weapon charges, which could carry up to 20 years in prison if convicted .

ICE has denied the allegation, calling it "reckless and false" and stating that Parra Hernández ran in front of an ICE vehicle after fleeing on foot . The agency has said Parra Hernández was not the target of the operation, but was in a vehicle with the target, identified as Jose Mendoza-Cervantes, whom ICE describes as unlawfully present with a final order of removal

A key witness who was handcuffed in the back of the ICE vehicle during the incident has been interviewed by the district attorney's office. Teare said the witness "had a front row seat to the incident and everything that led up to it" and that prosecutors obtained "a significant amount of relevant details" . The witness, identified by advocates as José Presa Cañada, is being held at the Port Isabel Processing Center, and advocates have expressed concern that he may be deported before the investigation concludes .

The officer's placement on administrative leave comes as the district attorney's office continues its investigation and prepares to present evidence to a grand jury, possibly as soon as next week . Multiple ICE officers at the scene were wearing body cameras, and ICE is reviewing the footage internally. No decision has been made about whether that footage will be released publicly or shared with the district attorney's office .

Parra Hernández, who is from Mexico and has lived in the United States for 34 years, remains hospitalized and in custody . His family and advocates have disputed ICE's account of the operation, including the identity of the man the agency identified as its target .
