Powell’s Silence on Fed Refurbishments Sparks Rule-of-Law Debate

Federal Reserve Chair Jerome Powell recently affirmed his “deep respect for the rule of law and for accountability in our democracy,” stating clearly that no one "certainly not the chair of the Federal Reserve" is above the law.

However, this commitment is now facing direct public challenge. Economist and former Fed nominee Judy Shelton has sharply criticized Powell for reportedly refusing to respond to Department of Justice inquiries about expensive refurbishments to the Fed’s facilities. Shelton argues that ignoring these DOJ requests demonstrates neither respect for the law nor a willingness to be accountable.

The core allegation is that Powell is using the principle of central bank “independence” as a shield to avoid transparency, rather than providing proper oversight of the institution he leads. Shelton characterizes this as an “act of transference” deflecting responsibility instead of accepting it.

The controversy hinges on a simple question of governance: Can a public official invoke institutional independence to withhold information from the nation’s top law enforcement agency? Shelton’s critique suggests that by continuing to ignore requests for information, Powell is behaving as if he is above the law, precisely because of his powerful position.

This clash places a spotlight on the tension between independent agency autonomy and the fundamental democratic requirement for transparency and legal accountability.
