For the parents of two journalists killed in Ukraine in March 2022, the answer to that question has become a legal and moral reckoning—one that places blame not on the Russian forces who fired the shots, but on the network that sent their colleagues into harm's way.

Fox News correspondent Benjamin Hall and photographer Pierre Zakrzewski were traveling in Horenka, near Kyiv, with Ukrainian fixer Oleksandra "Sasha" Kuvshynova when their vehicle came under fire. Zakrzewski and Kuvshynova were killed. Hall was severely wounded, losing part of a leg and suffering injuries that would require years of recovery .

Now, the parents of Zakrzewski and Kuvshynova have filed a lawsuit against Fox News and Hall, alleging that the network and its star correspondent proceeded with the assignment despite warnings about the danger. According to sworn affidavits obtained by NPR, Fox security contractors advised against the trip. One contractor testified that he told Hall it "wasn't in his best interest to go down there," and that Hall responded, "Ah, I'll go anyway" .

The suit also alleges that the Fox team was "overstressed and overworked" before Hall's arrival, and that Kuvshynova, the young Ukrainian fixer, was burdened with additional responsibilities as a result. A security adviser wrote in a sworn affidavit that a senior network executive or security official was supposed to sign off on each assignment, particularly those near the front .

Kuvshynova's parents, speaking from Kyiv, described their daughter as a remarkable young woman who had mastered English by age eleven and discovered her calling as a journalist during the 2014 Maidan uprising. She was excited to work with Fox, her mother said: "She said, 'I have already found my profession'" .

The lawsuit raises uncomfortable questions about the relationship between news organizations and the local fixers who make foreign reporting possible—often at great personal risk. It also asks whether the drive to "get the pictures," as one veteran foreign editor put it, can override the duty of care that networks owe to the people they send into danger .

Fox News has not publicly commented on the specifics of the litigation. For the parents, the legal action is not only about accountability. It is about ensuring that the decisions that led to their children's deaths are examined—and that others are not asked to take the same risks without the same scrutiny.
