The encounter then changed rapidly. Prosecutors presented video showing Garces Perez driving away and a subsequent pursuit through residential streets. Federal officers have alleged that he attempted to strike an officer with his vehicle or driver's-side mirror near the end of the pursuit, after which an ICE officer fired at him.

The shooting itself, however, was not captured by the body-camera footage presented in court. The federal officer who fired the weapon was not wearing a body camera, while another immigration officer's camera was turned off during the pursuit. Those details became part of the defense's argument about what the available evidence does and does not establish.

Garces Perez's attorneys have disputed the government's characterization of the incident. They argued that the footage was inconclusive and described the criminal case as retaliation. The defense also questioned whether the officer who was allegedly struck by the mirror was actually hit, noting that the officer did not have body-camera footage documenting the alleged contact.

The case has also drawn attention because Garces Perez was shot during the encounter and continues to require medical care, according to his attorneys. Reporting from the hearing said he appeared with his arm in a sling and needed assistance with some tasks. Those circumstances now sit alongside the criminal allegations as the court considers the case.

For the moment, the judge's decision concerns custody and the continuation of the prosecution, not a finding of guilt. The allegations remain allegations unless and until they are established through the legal process. The competing accounts of the pursuit, the alleged contact with the officer and the shooting itself remain central questions in the case.

The next stages will depend on further proceedings and evidence. For Garces Perez, his attorneys and federal prosecutors, the courtroom will remain the setting where the disputed sequence of events is examined more fully, while the circumstances surrounding the shooting continue to receive public attention.
