A Warehouse vs. Washington: Costco Stakes Claim on Trump Tariffs

The fluorescent lights of a big-box warehouse gleam early this December morning, but inside those aisles the hum of commerce carries a quiet urgency. On the storefront door of Costco, the usual promise of bulk goods and low prices now shares the weight of legal defiance and financial reckoning. In a bold move, Costco has filed suit — asking that the tariffs levied under emergency trade powers be refunded, potentially upending years of revenue for the government.

Costco’s challenge comes after lower federal courts ruled earlier this year that the sweeping import taxes imposed under the emergency authority of the International Emergency Economic Powers Act (IEEPA) were unlawful. The matter is now before the Supreme Court of the United States.

In its filing with the United States Court of International Trade, Costco argued that it seeks a “complete refund” of duties it paid — and also wants to pause any further tariff collections until the court rules. The company warned that once its tariff bills are “liquidated” by customs (a process slated to start mid-December), it could lose the ability to recover those funds even if the tariffs are later struck down.

Costco did not disclose exactly how much it has paid in tariffs, but it underscored that a significant portion of its U.S. products are imported — exposing the potential scale of refund claims if it succeeds.

Other large importers — like Revlon and Bumble Bee Foods — have filed similar actions, but Costco is the largest-revenue company among them to date.

For policymakers and markets alike, Costco’s lawsuit raises hard questions: if the Supreme Court invalidates the tariffs, will the federal government need to refund potentially billions of dollars? And will other importers — large and small — follow Costco’s lead to line up for reimbursements?

For now, Costco is acting to preserve its rights. Whether it obtains a refund — or whether customs laws and deadlines block that path — remains uncertain. The case could reshape how emergency-powered trade policies are enforced, and how importers respond when those policies unravel.
