A Committee Divided Speaks Past Itself, and the Work Waits

There is a particular tension that settles over a committee when its members stop speaking to one another and begin speaking past one another. The Senate Judiciary Committee, a body with a long tradition of bipartisan work, found itself in that posture this week as Chairman Chuck Grassley responded to Democratic demands for an apology with a four-page letter that defended his record and redirected the criticism.

The dispute stems from a September 29 hearing featuring former special counsel Jack Smith, who investigated President Donald Trump's efforts to overturn the 2020 election. During that hearing, Senator Eric Schmitt, a Missouri Republican, accused Smith of perjuring himself and suggested he had attended an Atlanta Hawks basketball game with Fulton County District Attorney Fani Willis. Smith was not at that game; he was in Maryland attending an Iowa Hawkeyes women's basketball game .

Ranking member Dick Durbin of Illinois sent a letter demanding that Republicans apologize to Smith for what he characterized as false accusations, and also sought the text messages Schmitt had used as the basis for his questioning . Grassley's response, transmitted Thursday, rejected the premise entirely.

"Contrary to your misguided statement, the major embarrassment of the hearing was Democrats falling over themselves defending unlawful and unconstitutional actions by Jack Smith," Grassley wrote . He accused Democrats of failing to engage in his oversight efforts, noting that he had invited them to assist in investigating what he called "Arctic Frost" and the special counsel's work, but that none had accepted .

The letter also addressed the dispute over records. Durbin's office said Republicans had withheld documents that formed the basis for the accusations against Smith. Grassley countered that his staff had provided hundreds of pages of records before the hearing and that he had released nearly 2,200 pages related to the investigation since January 2025 . He said some materials would not be shared until a later date to protect whistleblower sources from retaliation .

Grassley characterized the Democratic complaints as part of a pattern. He cited past instances where he said Democrats had leaked information from joint investigations and undermined oversight efforts, including the Biden family inquiry . "You see, your side can't argue about Rules when your side doesn't play by them," he wrote .

A spokesperson for Durbin responded that the letter "spends four pages spinning conspiracy theories without ever addressing the fact that Republicans continue to violate Senate Rules by withholding from Democrats the documents that were the basis for the false accusations of perjury against Jack Smith" . The spokesperson added that Republicans remain focused on attacking Smith rather than addressing the crimes he was investigating.

Both sides are scheduled to meet next week at the staff level, according to Grassley's letter. The committee, which has historically functioned with a degree of comity unusual in modern Congress, now finds itself navigating a dispute that touches on questions of procedure, transparency, and the boundaries of oversight.
